1251 S Eliseo is dangerous for the environment

The Marin IJ had an article today about how the Rose Ln residents are having trouble being allowed to put up pergolas in their yards because it might impact a nearby creek:

So, how can the city support the $20M apartment building at 1251 S eliseo with multiple downspouts directly into the creek?

Federal agencies that protect the environment shoul be involved. That foliage probably supports nesting habitat for the Ridgway Rail Bird and other threatened species:

The Bon Air Bridge is only 100 yards away.

Here is a list of potentially impacted endangered species:

2.3 California Red-Legged Frog
2.4 California Seablite
2.5 Delta Smelt

What will it take to make this building safe to inhabit? There are significant mold problems.
